The onslaught of criminal defamation continues by those sympathetic to a revisionist history of Bangladesh and are hell-bent on undermining the role played by Bangabandhu Sheikh Mujibur Rahman and Awami League. Unsupported sources say all of these criminally defamatory actions are to assist the reinstatement of BNP and its dark prince, Tarique Rahman. But, judiciary is stepping in to protect the dignity of all things that Bangladeshis stand for and that are important to the nation. A recent example shows that on 29 September 2021, Md. Bayezid Sheikh, a grassroots Awami League activist and supporter, lodged a criminal defamation case at the Dhaka Chief Judicial Magistrate’s Court against 47 individuals, including the editor-publisher and other officials of an online based newspaper called The Daily Nobojug, for making and publishing criminally defamatory statements against the Prime Minister, Father of the Nation Bangabandhu Sheikh Mujibur Rahman and his family, Bangladesh judiciary, judges and Awami League. The case is currently assigned the reference CR-797/2021. Sections 500 and 501 of the Bangladesh Penal Code 1860 have been invoked which carry sentences of imprisonment.
The accused are – Esrat Rashid (36, Editor, The Daily Nobojug), Johnny Joseph de Costa (32, Assistant Editor, Daily Nobojug), Nurul Huda (29, Senior Assistant Editor, Daily Nobojug), Md Tofail Hossain (Senior Advisor, Daily Nobojug), Ali Amin (39, Publisher, Daily Nobojug), Peerzada Tanvir Ahmed (24), Mohammad Shahidul Islam Jaigirdar (36), Md. Abdul Razzak (28), Md. Masum Sajjad (32), Ariful Haque Arif, Md Jakir Hossain (29), Md Razim Hossain (30), Shiplu Kumar Barmon (42), Musa Ahmed Jaigerder (31), Romana Akter Rumki (30), Mohammad Zillur Rahman, Mukit Chowdhury (34), Abu Sayed (25), Md. Al-Amin Kaisar (31), Md Maraz Miah (28), Md Shaim (20), Shahriar Md. Nafis Khan (32), Ahsanul Huda Sarker (47), Shamim Al Mamun (32), Ahsanul Kabir (35), Sultana Zebunnesa (43), Samiuzzaman Siddique (40), Md Sabbir Hossain (30), Md Zahirul Islam (33), Al Mahfuz (24), Md Obaidur Rahman Khan, Md. Arath Hossain Rony (29), Umma Kulsum Nargis Banu (39), Nurul Farooq Shaker (35), Mohammed Nizamul Haque (47). , Mohammad Fahidul Alam, Md Kanzid Hasan, Md Ashif Hossain and others others.
The court files show that the Daily Nobojug, already subjected to a number of prosecutions, published two articles titled “Al Jazeera Documentary, Mushtaq’s Death in Prison and Thoughts of Expatriates” and “Endangered Freedom of Speech in Bangladesh, Awami Fascism and Puppet Judiciary”. Both of these articles contained highly abusive, criminally threatening and vile comments which were directed towards the Hon’ble Prime Minister of Bangladesh Sheikh Hasina, her father Bangabandhu Sheikh Mujibur Rahman and the Government of Bangladesh, the Army and the National Intelligence Agency calling into question the government’s legitimacy and celebrating the darkest chapter of the country’s history, the cruel assassination of the father of the nation. Direct physical threats were made against the Prime Minister and designs of eradicating her and her family were openly discussed and published.
Cognizant of the gravity of the charges, Chief Judicial Magistrates’ Cognizance Court’s Senior Judicial Magistrate Razib Hasan ordered the case documents and evidence to be sent to the Additional Superintendent of Police (PBI) of Dhaka Metropolitan Police. The PBI has been directed to submit its report at the next hearing on 09 December 2021. Attempts to contact the government sources have been unsuccessful. The Daily Nobojug has been approached for its reaction. The case continues at the Dhaka Judicial Magistrates’ Court.
